Dear Sir:

 

At the Board meeting of December 21, 2023, the Board of Commissioners duly approved the above stated settlement in the amount of $15,431.54, Agenda Item No. 47, File No. 23-1238, Account 901-30000-667220.

 

The approved $15,431.54 payment for property damages has been paid. The bodily injury damage claim for this accident can now be submitted for your consideration.

 

On September 7, 2023, a District vehicle driven by employee Ken Thompson was exiting the Bishop Ford Expressway when it struck a vehicle driven by Andrew Frierson near 130th Street and Doty Avenue in Chicago, Illinois, causing damage to Mr. Frierson’s vehicle. In addition, Mr. Frierson sought medical treatment because of the accident.  Mr. Frierson sought treatment at Advocate Trinity Hospital.

 

Mr. Frierson treated with physical therapy and medication for left shoulder pain and cervical issues. Mr. Frierson retained an attorney to represent him against the District. The attorney has agreed to accept a settlement in the amount of $25,000.00 to resolve the bodily injury portion of his claim. 

 

Therefore, the total amount of the settlement should include the $15,431.54 for the cost of the vehicle damages plus the $25,000.00 cost for the bodily injury damages for a total amount of $40,431.54.

 

The Director of Human Resources believes this settlement is in the best interest of the District and requests payment in the amount of $25,000.00 be approved and he be authorized to execute such documents as may be necessary to effect the settlement.

 

Therefore, it is requested that the aforesaid Board order of December 21, 2023, be amended to effect the changes set forth above, otherwise to remain in force and effect as heretofore enacted. Funds are available in Account 901-30000-667220.
