Issue orders authorizing a twenty five (25)-year Easement to the City of Palos Hills to construct a pedestrian bridge over the District’s property known as Lucas Ditch located south of 107th Street and adjacent to the vacated portion of 78th Avenue in Palos Hills, Cook County, Illinois.  Consideration shall be a nominal fee of $10.00

Dear Sir:

 

The Law Department is in receipt of a request by Christopher B. Burke Engineering, Ltd. (“Burke Engineering”), on behalf of the City of Palos Hills (“City”), for a permanent easement to construct a pedestrian bridge over the District’s property known as Lucas Ditch located south of 107th Street and adjacent to the vacated portion of 78th Avenue in Palos Hills, Cook County, Illinois.  The project site is located on a portion of Lucas Ditch approximately 800 feet upstream of the confluence of Lucas Ditch with Stony Creek.  Attached is a map depicting the subject easement area.

 

The proposed bridge will connect city-owned property on either side of Lucas Ditch, and will be part of a recreation trail system that will be developed by the City throughout the adjacent properties. According to the plans and hydraulic analysis submitted by Burke Engineering to District’s Engineering Department, the proposed bridge has been designed so that the pile caps are located outside of the ditch banks and the bridge deck spans the entire width of the ditch. Burke Engineering has also submitted the subject hydraulic analysis to the Illinois Department of Natural Resources, Office of Water Resources for approval and permit issuance.

 

The District’s technical departments have reviewed the proposed City’s plans and hydraulic analysis and have no objections to the City’s request for an easement on the District’s property at the subject location. The easement will be subject to all technical conditions imposed by the District’s technical departments.  The City will also provide proof of self-insurance or general liability insurance naming the District as an additional insured. 

 

Accordingly, it is requested that the General Superintendent recommend to the Board of Commissioners that it authorize and approve the issuance of a twenty five (25)-year Easement to the City of Palos Hills to construct a pedestrian bridge over the District’s property known as Lucas Ditch, located south of 107th Street and adjacent to the vacation portion of 78th Avenue in Palos Hills, Cook County, Illinois.  Consideration shall be a nominal fee of $10.00.

 

It is also requested that the General Superintendent recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said Easement Agreement after it is approved by the Attorney as to form and legality.
