Dear Sir:

 

Antonio Soto worked as a Maintenance Laborer A at the Stickney Reclamation Plant. Mr. Soto retired effective May 1, 2022. On June 12, 2020, the employee strained his right arm while releasing a hand brake on a railroad car. The employee went to the industrial clinic on June 12, 2020, for injuries to his right shoulder and right arm.  He treated conservatively with medication and physical therapy; however, his right arm did not improve. On October 1, 2020, he underwent surgery to repair his right shoulder and was disabled from work at this time. After a course of physical therapy, he returned to work on November 17, 2020.

 

The employee continued to experience problems with his right elbow and was disabled from work again effective May 19, 2021. On June 15, 2021, he underwent a surgical procedure to repair his right elbow. After another course of physical therapy, he returned to work on August 13, 2021.

 

Mr. Soto was paid 19.40 weeks of lost time benefits totaling $21,437.15.        

 

Mr. Soto filed an Application of Adjustment of Claim with the Illinois Workers’ Compensation Commission (IWCC) through his counsel. Subject to the approval of the IWCC, this case can now be settled for a total of $94,504.14, representing approximately 15% loss of use of the person as a whole and approximately 15% loss of use of the right arm. This settlement will close out future lost time and medical benefits associated with this injury.

 

The Director of Human Resources believes this settlement is in the best interest of the District and requests payment of that sum be approved and she be authorized to execute such documents as may be necessary to effect the settlement.
