Dear Sir:
Authorization is requested to issue a purchase order and enter into an agreement with Agilent Technologies, Inc. (Agilent) to furnish and deliver an Agilent 7850 Inductively Coupled Plasma Mass Spectrometer (ICP-MS) bundle, including autosampler, advanced valve system, auto-dilution system, installation, training, preventative maintenance, enhanced extended warranty, and consumable supplies and parts. This purchase order will expire on December 31, 2029.
The Agilent computer-controlled ICP-MS system is essential for analyzing trace metals, which are routinely examined in samples required for National Pollutant Discharge Elimination System (NPDES) permits issued to the District’s seven Water Reclamation Plants. Additionally, regulatory samples from waterways, wells, and lysimeters in sludge drying areas undergo this analysis. However, the current instrument used for metal analysis is no longer in production and is nearing the end of its operational life.
Agilent, the sole service provider of the Agilent 7850 ICP-MS bundle, training, preventative maintenance, enhanced extended warranty, and consumable supplies and parts has submitted prices for the instrument and services required. Agilent is the exclusive manufacturer and supplier, and sole provider of the 7850 ICP-MS instrument bundle with autosampler, advanced valve system, and auto-dilution system and provides the benefit of the entire system being maintained by the same vendor. Agilent is the industry leader on ICP-MS technology and has the rights to multiple patents related to the instrument. Inasmuch as Agilent, is the only source of supply for the ICP-MS bundle and services required, nothing would be gained by advertising for bids (Section 11.4 of the Purchasing Act).
Agilent is registered and is in good standing with the State of Illinois.
The Multi-Project Labor Agreement and Affirmative Action Appendix A are not applicable due to the specialized nature of the services required.
In view of the foregoing, it is recommended that the Director of Procurement and Materials Management be authorized to issue a purchase order and enter into an agreement with Agilent Technologies, Inc., in an amount not to exceed $304,710.39.
Funds for the 2024 expenditure in the amount of $254,710.39, are available in Accounts 101-16000-612970, 634970. The estimated expenditures for 2025, 2026, 2027, 2028 and 2029 is $10,000.00 per year, in Account 101-16000-623570. Funds for the 2025-2029 expenditures are contingent on the Board of Commissioners’ approval of the District’s budget for those years.
