Dear Sir:
On June 2, 2022, the Board of Commissioners authorized the Director of Procurement and Materials Management to advertise for bids, Contract 23-665-11, Landscape Maintenance at Various Service Areas.
In response to a public advertisement September 14, 2022, a bid opening was held on October 11, 2022. The sole bid was rejected as reported at the Board Meeting of November 17, 2022.
In response to a public re-advertisement of March 8, 2023, a bid opening was held on April 4, 2023. All bids were rejected as reported at the June 1, 2023 Board meeting.
In response to a public re-advertisement of June 14, 2023, a bid opening was held on July 11, 2023.

The Associated goals for this contract are 20 percent Minority-owned Business Enterprise (MBE), 9 percent Women-owned Business Enterprise (WBE), and 3 percent Veteran Business Enterprise (VBE) for each group.
Diaz Group, LLC (Diaz) submitted a low bid for Groups A, B, C, and D. Diaz has informed the District that they are not a union company and do not operate under any umbrella of union labor and cannot complete and sign the MPLA certificate of compliance indicating the union they are signatory as required. Therefore, it appears that Diaz is not signatory to a union and cannot comply with the Multi-Project Labor agreement. The MPLA is a requirement of this contract. Therefore, Diaz’s bid is considered non-responsive and rejected. The Director of Procurement and Materials Management has notified Diaz of this action.
Global Maintenance Solutions (Global) submitted a bid for Groups A, B, C, and D. The Maintenance and Operations Department reviewed the bid for Global and indicated that they did not comply with the contract specifications for experience, equipment, and ability to perform the required work as described in the Detail Specifications. Therefore, Global’s bid is considered non-responsive and rejected. The Director of Procurement and Materials Management has notified Global of this action.
Lizzette Medina & Co. (Lizzette) submitted bids for Groups A, B, C, and D. For Group A, Lizzette offered 15.9% MBE, 9% WBE, and no participation for VBE. For Group B participation is 15.7% MBE, 9% WBE, and no participation for VBE. For Group C participation is 16.7% MBE, 9% WBE, and no participation for VBE. For Group D participation is 11.9% MBE, 9% WBE, and no participation for VBE. No waiver request was submitted for any group.
A review of Lizzette’s utilization plan by the Acting Diversity Administrator revealed that this bidder did not comply with the Affirmative Action Ordinance Revised Appendix D, for not meeting the goal attainment for MBE participation at 20% and did not submit a waiver request for the shortfall as required.
Therefore, Lizzette did not comply with Section 15 Utilization Plan Submission (c) and (e) and Section 16 Bid Submission Compliance Review (a)(ii).
The Director of Procurement and Materials Management has informed Lizzette that their bid is considered non-responsive and rejected.
The Maintenance and Operations Department will re-advertise this contract at a future date.
