Dear Sir:

 

The United States Department of Agriculture’s (USDA), Natural Resources Conservation Service (NRCS) has contacted the District regarding the status of the Operation and Maintenance Agreements for three reservoirs in the Upper Salt Creek Watershed: Structure No. 2, Plum Grove Reservoir; Structure No. 3, St. Michael Reservoir and Structure No. 4, Twin Lakes Reservoir for which the District is a local sponsor.  The subject reservoirs with dam structures were funded with federal money through PL-566 Watershed Protection and Flood Prevention Act.

 

NRCS is reviewing the Operation and Maintenance (O&M) Agreements and Emergency Action Plans (EAP) for each of the structures and having the local sponsors (MWRDGC being one of them) sign an Amendment to each agreement (Amendment) to provide that each O&M agreement will be reviewed at least every five (5) years and each EAP will be reviewed annually.

 

We have reviewed the Amendment for the subject three reservoirs and find them to be acceptable as to form.  EAPs will be reviewed at a later date and revised, as needed, and forwarded to USDA.

 

Accordingly it is requested that the Chairman of the Committee on Finance and Clerk be authorized and directed to execute each of the Amendments after same are approved by the Chief of M&O as to technical matters and by the Attorney as to form and legality.
