Dear Sir:
On June 19, 2008, the Board of Commissioners authorized the Director of Procurement and Materials Management to advertise for bids, Contract 07-163-3M, R & D Building HVAC Improvements, Stickney Water Reclamation Plant.
In response to a public advertisement of July 9, 2008, a bid opening was held on August 19, 2008. No bids were received for this contract.
At the Board Meeting of October 16, 2008, the Board approved to increase the cost estimate of this contract from $6,500,000.00 to $7,400,000.00.
In response to a public re-advertisement of January 21, 2009, a bid opening was held on April 7, 2009. The bid tabulation for this contract is:

Eight hundred sixty-one (861) companies were notified of this contract being advertised and twenty-two (22) companies requested specifications.
Path-Milhouse Joint Venture, the lowest responsible bidder, is proposing to perform the contract, in accordance with the specifications.
The estimated cost for this contract was $7,400,000.00, placing the bid of $8,253,300.00, approximately 11 percent above the estimate.
Path-Milhouse Joint Venture, is in compliance with the Revised Appendix D as indicated on the attached report. The protected class utilization for this contract is 20 percent Minority Business Enterprise (MBE), 9 percent Women Business Enterprise (WBE), and the bidder offers MBE credits to satisfy Small Business Enterprise (SBE) participation.
Path-Milhouse Joint Venture, has executed the Multi-Project Labor Agreement (MPLA) certificate as required. The construction trades anticipated to be utilized on this contract are: laborers. The list of construction trades is not intended to confer any rights or jurisdiction upon any union or unions.
In view of the foregoing, it is recommended that the Director of Procurement and Materials Management be authorized to award Contract 07-163-3M (Re-Bid), to Path-Milhouse Joint Venture, in an amount not to exceed $8,253,300.00, subject to the contractor furnishing a performance bond in form satisfactory to the Law Department and approved by the Director of Procurement and Materials Management.
Funds are available in Accounts 401-50000-645680, 645780.
