Dear Sir:
On June 16, 2022, the Board of Commissioners authorized the Director of Procurement and Materials Management to advertise for bids Contract 22-902-21, Influent Gate Demolition at the Stickney Water Reclamation Plant.
In response to a public advertisement of August 24, 2022, a bid opening was held on September 20, 2022. No bids were received.
In response to a public re-advertisement of April 5, 2023, a bid opening was held on May 2, 2023. At the Board meeting of May 18, 2023, the bid was rejected as reported.
At the Board meeting of June 1, 2023, authorization was granted to increase the cost estimate as reported.
In response to a public re-advertisement of June 7, 2023, a bid opening was held on July 11, 2023.
The bid tabulation for this contract is:

John Burns Construction Company, LLC, the lowest responsible bidder, is proposing to perform the contract in accordance with the specifications. The estimated cost of this contract was $1,571,000.00, placing their bid of $1,373,000.00 approximately 12.6 percent below the estimated cost.
John Burns Construction Company, LLC has executed the Multi-Project Labor Agreement (MPLA) certificate as required. It is anticipated that the following construction trades will be utilized on this contract: carpenters, electricians, laborers, and truck drivers. The list of construction trades is not intended to confer any rights or jurisdiction upon any union or unions.
The Minority-owned Business Enterprises (MBE), Women-owned Business Enterprises (WBE), and Veteran-owned Business Enterprises (VBE) utilization goals for this contract are: 20% MBE, 10% WBE, and 3% VBE.
John Burns Construction Company, LLC, is in compliance with the Affirmative Action Ordinance, Revised Appendix D as indicated on the attached report. The Minority Business Enterprise (MBE) and Women Business Enterprise (WBE) utilization goals for this contract are 20.02 percent MBE and 10.05 percent WBE. The bidder committed to 3.05 percent for the VBE goal.
The contract will require approximately ten (10) people for the services.
The work under his contract shall commence upon approval of the Contractor's Bond and terminate eighteen months thereafter, or upon expenditure of available funds, whichever occurs sooner.
In view of the foregoing, it is recommended that the Director of Procurement and Materials Management be authorized to award Contract 22-902-23, to John Burns Construction Company, LLC, in an amount not to exceed $1,373,000.00, subject to the contractor furnishing a performance bond in form satisfactory to the Law Department and approved by the Director of Procurement and Materials Management.
Funds for the 2023 expenditure, in the amount of $500,000.00 are available in Account 201-50000-645700. The estimated expenditure for 2024 is $873,000.00. Funds for the 2024 expenditure is contingent on the Board of Commissioners’ approval of the District’s budget for that year.
