TRANSMITTAL LETTER FOR BOARD MEETING OF OCTOBER 15, 2009

COMMITTEE ON STORMWATER MANAGEMENT

Mr. Richard Lanyon, Executive Director

Title

Authority for the Executive Director to execute rental agreements with five (5) high schools within the watershed planning areas of Cook County for the purpose of conducting Cook County Watershed Management Ordinance Study Sessions

Body

Dear Sir:

The public review process for the Cook County Watershed Management Ordinance (WMO) commenced September 28, 2009 and will conclude December 31, 2009.  The public review process will include five (5) Board of Commissioner Study Sessions conducted within the watershed planning areas of Cook County.  The ideal venue for the Study Sessions was determined to be high school auditoriums, which provide ample seating and parking, in addition to suitable sound equipment.

The venues identified thus far all require execution of rental agreements by the District. The total estimated cost to rent all five (5) venues is approximately $4,000.00 and will be paid via direct voucher.  All of the rental agreements include an indemnification clause that require the District to indemnify and hold harmless the school districts from all claims and losses incurred by the school districts as a result of the District’s use of their facilities. The request for indemnification under the circumstances is reasonable and standard.

Based on the foregoing, the Law Department recommends that the District be authorized to enter into rental agreements with high schools in five watershed planning areas and that the Executive Director be authorized to execute said rental agreements on behalf of the District, upon approval by the General Counsel as to form and legality.

Funds for this expenditure are available in Account 501-50000-612330, Stormwater Management Fund.

Requested, Frederick M. Feldman, General Counsel, FMF:RMH:jvs

Respectfully Submitted, Debra Shore, Chairman Committee on Stormwater Management
