Dear Sir:

 

Sean Kelly is a Treatment Plan Operator II working at the Kirie Water Reclamation Plant. On December 17, 2020, he reported while opening a raw sewage influent manual wheel chain valve that the wheel chain fell approximately twenty feet, striking him on the head, neck, right shoulder, and right wrist. The employee was seen at the hospital emergency room on December 17, 2020. He was initially diagnosed with a concussion, right wrist laceration, and injuries to lower back and cervical spine. The employee was initially disabled effective December 18, 2020, and was treated with medication and extensive physical therapy. He returned to work initially on February 4, 2021. The employee continued to undergo treatment and on April 13, 2021, he underwent an epidural steroid injection. He was disabled the next day on April 14, 2021. The employee began work conditioning for his lumbar spine on April 27, 2021 at which time he was disabled from work again. The employee returned to work on June 2, 2021.

 

Mr. Kelly was paid a total of 12.2 weeks of lost time benefits totaling $17,728.16.

 

Mr. Kelly filed an Application of Adjustment of Claim with the Illinois Workers’ Compensation Commission (IWCC) through his counsel. Subject to the approval of the IWCC, this case can now be settled for a total of $50,000.00, representing approximately 5% loss of use of person as a whole for the concussion, approximately 2% loss of use for the cervical spine, and approximately 4.47% loss of a person as a whole for the lumbar spine. This settlement will close out future lost time and medical benefits associated with this injury.

 

The Director of Human Resources believes this settlement is in the best interest of the District and requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.
