Dear Sir:

 

At the Board meeting of April 20, 2023, the Board of Commissioners duly approved the above stated settlement in the amount of $4,872.15, Agenda Item No. 27, File No. 23-0372, Account 901-30000-667220.

 

The approved $4,872.15 payment for property damages has been paid. The bodily injury damage claim for this accident can now be submitted for your consideration.

 

On January 12, 2023, Robert De La Torre, a District employee, was driving a District vehicle in stop and go traffic on Harlem Ave in River Forest, IL, when the District vehicle rear ended the vehicle driven by Antoinesha Davis. Ms. Davis is claiming injuries because of the accident and sought treatment at Rush Oak Park Hospital.   

 

Ms. Davis underwent conservative treatment consisting of medication and Chiropractic treatment for multiple soft tissue, lumbar and cervical injuries.

 

Ms. Davis retained an attorney to represent her against the District. The attorney has agreed to accept a settlement in the amount of $26,500.00 to resolve the bodily injury portion of her claim. 

 

Therefore, the total amount of the settlement should include the $4,872.15 for the cost of the vehicle damages plus the $26,500.00 cost for the bodily injury damages for a total amount of $31,372.15. The Director of Human Resources believes this settlement is in the best interest of the District and requests payment in the amount of $26,500.00 be approved and he be authorized to execute such documents as may be necessary to effect the settlement.

 

Therefore, it is requested that the aforesaid Board order of April 20, 2023, be amended to effect the changes set forth above, otherwise to remain in force and effect as heretofore enacted. Funds are available in Account 901-30000-667220.
