Dear Sir:

 

On October 4, 2007, the Board of Commissioners passed an order directing the Purchasing Agent to advertise for bids for Services of Heavy Equipment with Operators for Material Handling at the Lawndale Avenue Solids Management Area.

 

In response to a public advertisement of November 21, 2007, a bid opening was held on December 18, 2007.  The sole bid received for this contract is:

 

M.A.T. LEASING, INC.                     $426,912.50

 

Three hundred forty-eight (348) companies were notified of this contract being advertised and eight (8) companies requested specifications.

 

The quantities specified in the contract documents were used for the purpose of comparing bids and establishing unit prices.  The total amount to be expended on this contract, should usage differ from the estimated quantities, is not to exceed $425,000.00.

 

The Purchasing Agent has reviewed the bidders’ list for this contract, and is satisfied that the market for this service has been adequately solicited.  A planholders’ survey revealed the following reasons for firms not bidding:  firms cannot provide required equipment, cannot supply the operators, and contract is outside their area of business.  In light of these findings, the Purchasing Agent is of the opinion that the bid received is a fair and reasonable price, and nothing would be gained by rejecting the sole bid and re-advertising this contract.

 

M.A.T. Leasing, Inc., the sole bidder, is proposing to perform this contract, all in accordance with our specifications.  The estimated cost for this contract was $425,000.00, placing the bid of $426,912.50, approximately equal to this estimate.  The Contractor is in compliance with Revised Appendix D as evidenced by the attached report.  The protected class utilization is 15 percent MBE, 10 percent WBE, and the bidder is using WBE participation to meet the SBE goal.

 

M.A.T. Leasing, Inc., has executed the Multi-Project Labor Agreement certificate as required.  The trades anticipated to be utilized on this contract are Operating Engineers.  The list of construction trades is not intended to confer any rights or jurisdiction upon any union or unions.

 

In view of the foregoing, it is recommended that this contract be awarded to M.A.T. Leasing, Inc., in an amount not to exceed $425,000.00, subject to the contractor furnishing a performance bond in form satisfactory to our Legal Department and approved by the Purchasing Agent.  Funds are available in Account 101-66000-612520.
