Mr. John P. Murray, Executive Director

Title

Authority to grant the Village of Summit a 25-year, approximately 0.28-acre non-exclusive easement to continue operating and maintaining a 10-inch diameter sanitary sewer traversing portions of District Main Channel Parcels 34.02 and 34.09. Consideration shall be a nominal fee of $10.00

Body

Dear Sir:

The Village of Summit (“Village”) operates and maintains a 10-inch diameter sanitary sewer traversing portions of Main Channel Parcels 34.02 and 34.09 in Summit, Illinois. The easement commenced November 15, 2001, and expires November 14, 2026.

The Village has requested a new 25-year easement to continue operating and maintaining the sanitary sewer. Main Channel Parcels 34.02 and 34.09 are leased by Owens Corning Roofing and Asphalt, LLC. The Village will be required to coordinate access and maintenance of the sewer with the tenant.

The District’s technical departments have reviewed the Village’s easement request and have no objections thereto. A nominal fee of $10.00 is recommended as is customary for governmental entities using District property for a public purpose.

It is requested that the Executive Director recommend to the Board of Commissioners that it grant the Village of Summit a 25-year, approximately 0.28-acre non-exclusive easement to continue operating and maintaining a 10-inch diameter sanitary sewer traversing portions of District Main Channel Parcels 34.02 and 34.09. Consideration shall be a nominal fee of $10.00.

It is further requested that the Executive Director recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said easement agreement after it is approved by the General Counsel as to form and legality.

Requested, Susan T. Morakalis, General Counsel, STM:BJD:MM:vp

Recommended, John P. Murray, Executive Director
