TRANSMITTAL LETTER FOR BOARD MEETING OF MAY 16, 2024

COMMITTEE ON STORMWATER MANAGEMENT

Mr. Brian A. Perkovich, Executive Director

Title

Authority to negotiate and enter into an Intergovernmental Agreement with and make payment to the Village of Franklin Park for the design, construction, operation, and maintenance of the Pacific Avenue and Washington Street Green Infrastructure in Franklin Park (24-IGA-10) in an amount not to exceed $214,200.00

Body

Dear Sir:

Authorization is requested to negotiate and enter into an Intergovernmental Agreement (IGA) with and make payment to the Village of Franklin Park (Village) for the design, construction, operation, and maintenance of the Pacific Avenue and Washington Street Green Infrastructure in Franklin Park (24-IGA-10), in an amount not to exceed $214,200.00.

As detailed in a Report on Green Infrastructure (GI) Project Submittals presented to the Board of Commissioners on May 2, 2024, between July 2023 and March 2024 the District solicited GI project proposals from municipalities, townships, and other governmental agencies for District assistance, and received 22 applications. Of the 22 project applications received, the Engineering Department identified 12 projects that could be advanced through partnerships based on the anticipated funding available in 2025 for the District’s stormwater management program, including the subject project.

Under this project, the Village proposes replacing existing areas of impervious surface with rain gardens along the Pacific Avenue and Washington Street industrial corridors, as depicted in the attached exhibit. The project is expected to help mitigate flooding in the project area and demonstrate to local residents the benefits of constructing GI. The project will reduce and attenuate stormwater runoff in the vicinity of the project area and the gallons of stormwater storage constructed will be included in the District’s annual reporting to the United States Environmental Protection Agency for the GI portion of the District’s consent decree.

The terms of the IGA will include payment by the District towards construction costs based on the total Designed Retention Capacity (DRC), or stormwater storage, the project provides. District funding will be provided at a fixed rate per gallon of DRC and capped at an amount not to exceed $204,200.00. The District retains the discretion to adjust the amount of its reimbursement based on the project’s final constructed DRC. Additionally, the District is providing separate funds, to be available if needed, to assist with environmental site assessment services in an amount not to exceed $10,000.00. The total project cost, including design and permitting, is estimated to be $463,895.00. Partial payments to the Village, to be set forth in the IGA, will be made at predefined intervals during construction, which is anticipated to commence in 2025. The Village will be responsible for design, construction, operation, and maintenance of the project. The IGA will contain provisions that allow the District to review the project’s design and perform inspections after construction. The IGA will also require the Village to advertise and award the construction contracts in conformance with the District’s Purchasing Act, Multi-Project Labor Agreement, and Affirmative Action Requirements.

The Affirmative Action goals to be applied will conform with the current requirements of the District’s Affirmative Action Ordinance upon execution of this IGA. After construction, the Affirmative Action utilization on this project will be provided in an annual report summarizing goal attainment on stormwater partnerships.

Based on the foregoing, it is requested that the Board of Commissioners grant authority for the District to negotiate and enter into an IGA with and make payment to the Village in an amount not to exceed $214,200.00. It is further requested that the Chairman of the Committee on Finance, Executive Director and Clerk be authorized to execute said agreement on behalf of the District, as well as any documents necessary to effectuate the transaction and conveyance, upon approval by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.

Funds from Account 501-50000-612400 requested in future years are contingent on the Board of Commissioners’ approval of the District’s budget for that year.

Requested, Catherine A. O’Connor, Director of Engineering, KMF:JK

Recommended, Brian A. Perkovich, Executive Director
