Authority to settle the Workers’ Compensation Claim of John Tatarczuch vs. MWRDGC, Case 12 WC 25707, Illinois Workers’ Compensation Commission (IWCC), in the sum of $185,000.00, Account 901-30000-601090

Dear Sir:

 

John Tatarczuch is a retired Maintenance Laborer at the Calumet Water Reclamation Plant.  On August 17, 2009, he sustained injuries to his head, back, left arm and left leg when he fell through a set of gratings into the water with one of the gratings striking him on the head.  Mr. Tatarczuch was seen at the Emergency Room where he was treated with medicine and physical therapy for his head and back injuries.  Mr. Tatarczuch was disabled on August 18, 2009.  On December 10, 2009, he underwent a procedure.  Mr. Tatarczuch was paid duty disability benefits from August 18, 2009, through June 30, 2011.  The employee retired from the District on July 1, 2011.  He later required a total knee replacement which was performed on July 20, 2012.

 

Mr. Tatarczuch was paid a total of $84,497.20, which represents approximately 97.15 weeks of lost time benefits.

 

Mr. Tatarczuch’s attorney filed an Application of Adjustment of Claim with the Illinois Workers’ Compensation Commission.  Subject to the approval of the IWCC, this case can now be settled for $185,000.00, representing approximately 55.66% loss of person as a whole. This settlement will close out future lost time benefits, as well as any future medical benefits associated with this injury.

 

The Director of Human Resources believes this settlement is in the best interest of the District and requests payment of that sum be approved and she be authorized to execute such documents as may be necessary to effect the settlement.
