On January 9, 2025, the Board of Commissioners authorized the Director of Procurement and Materials Management to award Contract 23-169-1S McCook Reservoir Stage 1 Sediment Removal, to K.L.F. Enterprises, Inc. in an amount not to exceed $9,197,183.95, plus a five (5) percent allowance for change orders in an amount of $459,859.20, for a total amount not to exceed $9,657,043.15. The scheduled contract completion date is October 11, 2026.
As of July 17, 2026, the attached list of change orders has been approved.

The purpose of Contract 23-169-1S is to remove and dispose of up to approximately 56,000 cubic yards (CY) of sediment by means of trucking from Stage 1 of the McCook Reservoir, as well as to remove and dispose of a steel aerator pole on the bottom of the McCook Reservoir in Stage 1.
As of July 31, 2026, a total of 40,905 CY of the planned 56,000 CY of sediment has been removed from the reservoir and transported to the LASMA decanting site. In accordance with the contract specifications, the contractor is required to perform Resource Conservation and Recovery Act (RCRA) testing for every 5,000 CY of material removed to determine the appropriate waste classification. To date, none of the material tested has been classified as special or hazardous. Therefore, the District would like to reappropriate these funds to remove and dispose of additional sediment while the contractor remains mobilized on site.
The contract includes Allowance Item, Cost Proposal B, which provides $2,000,000 for incremental costs related to removing, handling, and disposing of material classified as special or hazardous. Since this allowance item has not been used to date, it is anticipated that the remaining sediment removal will also not utilize this allowance item. The scope of this change order is to reallocate the $2,000,000 of Cost Proposal B to other contract items for additional removal and disposal of sediment from the reservoir. The proposed change order covers hauling and removal of material, conducting volume surveys, handling and decanting operations, clearing haul routes, performing RCRA testing, and disposing of the sediment. It is anticipated that approximately 19,100 additional cubic yards of sediment will be removed from the McCook Reservoir and disposed. The contractor submitted a proposal (CO-3) for this work, for an extra in the amount of $1,996,672.46, and a credit in the amount of $2,000,000.00, for a net credit in the amount of $3,327.54. The Engineer reviewed this proposal, found it acceptable and stated via correspondence CO3 that the Engineering Department would recommend its approval.
This change order is in compliance with the Illinois Criminal Code since the change is due to circumstances not reasonably foreseeable at the time the contract was signed and is in the best interest of the District.
It is hereby recommended that the Board of Commissioners authorize the Director of Procurement and Materials Management to execute a change order to decrease Contract 23-169-1S in an amount of $3,327.54 (-0.04% of the current contract value), from an amount of $9,039,237.03, to an amount not to exceed $9,035,909.49.
Funds will be restored to Account 101-50000-612620.
