Dear Sir:
 
Authority is requested to amend an agreement with the Village of Ford Heights for the Deer Creek Reservoir. On July 10, 1997, the Board of Commissioners (Board) approved participation as the Local Sponsor for the construction of the Deer Creek Reservoir (Reservoir) in the Village of Ford Heights (Village) in cooperation with the U.S. Army Corps of Engineers (Corps). The District entered into an Intergovernmental Agreement (IGA) with the Village on May 15, 2002, to operate and maintain the reservoir spillway and diversion structure and to provide the Village $700,000 to be used solely and exclusively to defray costs incurred by the Village in connection with the execution of the Reservoir.
 
Subsequently, additional unforeseen costs necessary for completion of the Reservoir were identified by the Corps, including further excavation, streambank repairs, and mitigation for wetland impacts.  Additional funding in the amounts of $250,000 and $659,337 were approved by Board on May 4, 2006, and March 3, 2011, respectively.  The IGA requires modification to reflect the total amount of funding provided to date, which is $1,609,337, by the District for the Reservoir.
 
Section 3 of the IGA calls for the District to maintain the Reservoir's spillway and diversion structures, but the location of these structures is not described properly in the IGA; the amendment will address this issue.   
 
It is respectfully requested that the Executive Director recommend to the Board of Commissioners that it grant the authority to amend an agreement with the Village of Ford Heights for the Deer Creek Reservoir.
 
The amendment shall be subject to the approval of the Law Department as to form and legality.
