Authority to ratify the Executive Director’s June 30, 2009 execution of a two day permit for New Line Production, Inc. to use District land located at the Stony Island Solids Drying Area for filming related to a sequel for the motion picture - Nightmare on Elm Street.  Consideration is a permit fee of $10,000.00

Dear Sir:

 

New Line Productions, Inc. requested that the District allow it to use land located in the area of the District's Stony Island Solids Drying Area as a staging area, and for filming scenes for a sequel to the motion picture "Nightmare on Elm Street."  However, New Lines needed to access District land on June 30, 2009 and the next District Board meeting was scheduled for July 9, 2009.  Upon polling the Board of Commissioners, the Executive Director authorized the issuance of the permit subject to certain conditions, including that the permit fee be $10,000.00 instead of the $1,000.00 fee New Line proposed to pay.  The higher fee was warranted not only due to the requested use, but also due to the short time the District had to process this request because of insufficient advance notice from New Line.

 

The permit allowed for parking, tents, portable sanitary facilities, and other equipment to be placed at certain locations and a scene to be filmed outside the fenced area.  Because the filming relates to a horror film of which the District has no control over content, the District's signs, logo, or identification of the property with the District is not permitted in the movie.  However, this does not preclude acknowledgment of the District's cooperation in the film's closing credits, which they indicated they would likely do but could not contractually obligate itself to do so.

 

The staging and filming occurred on June 30, 2009 and the property was to be cleaned and otherwise restored on July 1, 2009.  On June 30, 2009 the Executive Director executed, on behalf of the District, the permit as aforementioned.

 

It is requested that the Board of Commissioners ratify the Executive Director’s June 30, 2009 execution of a two day permit for New Line Production, Inc. to use District land located at the Stony Island Solids Drying Area for filming related to a sequel for the motion picture - Nightmare on Elm Street.  Consideration is a permit fee of $10,000.00.
