Dear Sir:
On September 18, 2025, the Board of Commissioners authorized the Director of Procurement and Materials Management to advertise for bids Contract 26-677-11, Overhead Door Maintenance at Various Service Areas.
In response to a public advertisement of November 5, 2025, a bid opening was held on December 2, 2025. Bids were rejected as reported at the January 8, 2026 Board meeting.
In response to a public re-advertisement of January 14, 2026, a bid opening was held on February 10, 2026. The bid tabulation for this contract is:

At the July 16, 2026 Board meeting, BCE-USE, LLC (BCE) was awarded Groups A, B, and C. On the September 17, 2026, under a separate action, the District is requesting authorization to rescind the award.
The associated goals for this contract are 7% Minority-owned Business Enterprises (MBE) and/or Women-owned Business Enterprises (WBE) to comply with the Affirmative Action Ordinance Revised Appendix D. Builders Chicago Corporation (Builders), the next lowest bidder, offered 7% MBE and 0% WBE participation for Groups A, B, and C.
The Diversity Administrator has reviewed the utilization plans submitted by Builders for this contract. The review determined that the referenced utilization plans do not comply with the requirements stated in the Affirmative Action Ordinance Revised Appendix D. Specifically, for Groups A, B, and C, Builders is using their MBE to provide supplies only for each group for their goal as follows: Group A $14,190.00, Group B $9,567.00, and Group C $15,015.00. The Diversity Administrator has concluded that Builders has exceeded the allowable supplier exception under the Ordinance.
In accordance with Section 14. Counting MBE and WBE Participation Towards Contract Goals: (j) Purchase of materials and supplies must be pre-approved if their purchase is related to contract goal attainment. The bidder may count payments to MBE or WBE regular dealers or manufacturers for contract goal attainment for no more than fifty (50%) percent of each MBE or WBE goal, unless otherwise approved by the Administrator. If the bidder exceeds the supplier exception amount allowable as stated in the bid documents, the bid will be viewed as non-responsive.
Therefore, Builders did not comply with the Ordinance under Section 14. Counting MBE and WBE Participation Towards Contract Goals and therefore, is considered non-responsive and rejected based on the above information and in the public’s best interest. The Director of Procurement and Materials Management has notified Builders of this action.
The Maintenance and Operations Department will re-advertise the contract at a future date.
