Authority to enter into a 50-year lease with the Village of Lemont and Lemont Park District on 27+ acres of District real estate located south of the Main Channel and west of Stephen Street in Lemont, Illinois; Main Channel Parcel 23.04.  Consideration shall be a nominal fee of $10.00, plus 25% of the net revenues generated by their use of the leasehold

Dear Sir:

 

The Village of Lemont (“Village”) and Lemont Park District (“Park District”) have requested a 50-year lease on 27+ acres of District real estate located south of the Main Channel and west of Stephen Street in Lemont, Illinois, known as Main Channel Parcel 23.04.  The parcel is currently vacant.  The Village and Park District are requesting to lease this site for public and recreational use and to maintain a public park, walking trail, music pavilion, parking lot, and soccer and athletic fields; maintain seasonal facilities such as a disc golf course, volleyball courts, and skating rinks; and host community events such as an annual Fourth of July Celebration, summer concerts, Fall and Winter themed festivals and youth and adult sporting events.

 

The Village and Park District are also requesting to allow the sale and/or consumption of alcohol at certain of these events.  Such use is authorized by Illinois State Statute 235 ILCS 5/6-15, which permits the sale and consumption of alcohol on District-owned real estate that is leased to others for a term of at least 20 years, if approved by the District’s Board of Commissioners.  The Village and Park District shall be responsible for ensuring compliance with all applicable state and local liquor laws.

 

The District’s technical departments have reviewed this lease request and have no objections thereto.  A nominal fee of $10.00 is recommended plus 25% of the net revenues generated by the Village and Park District’s use of their leasehold as is customary for governmental entities using District land for a public purpose.

 

Under 70 ILCS 2605/8c(11), the lease would be terminable upon service of a one-year notice if the property becomes essential to the District’s corporate needs.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize the District to enter into a 50-year lease with the Village of Lemont and Lemont Park District on 27+ acres of District real estate located south of the Main Channel and west of Stephen Street in Lemont, Illinois; Main Channel Parcel 23.04.  Consideration shall be a nominal fee of $10.00, plus 25% of the net revenues generated by their use of the leasehold.

 

It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute said lease agreement after it is approved by the General Counsel as to form and legality.
