Body
Dear Sir:
On December 5, 2024, the Board of Commissioners authorized the Director of Procurement and Materials Management to award Contract 08-174-3D Battery A Improvements and Battery B Installation of Mechanical Mixers, SWRP, to IHC Construction Companies, LLC, in an amount not to exceed $56,449,000.00, plus a five (5) percent allowance for change orders in an amount of $2,822,450.00, for a total amount not to exceed $59,271,450.00. The scheduled contract completion date is October 26, 2027.
As of October 16, 2026, the attached list of change orders has been approved.
Original Contract Amount $56,449,000.00
Date of Board Approval 12/5/2024
Cumulative Change Order (10/16/2026) $1,237,617.09
% Change of Original Contract Value 2.19%
Current Contract Value $57,686,617.09
Requested Increase $588,621.38
New Contract Value $58,275,238.47
% Change of Current Contract Value 1.02%
Total % Change of Original Contract Value 3.24%
Item 1: An extra in an amount of $237,357.70 is requested for the clearing of unknown obstacles encountered during the micropile predrilling process. This contract includes the installation of micropiles to support the reconstruction of “F” Street at the Stickney Water Reclamation Plant. During construction, unknown obstacles were discovered at multiple micropile locations, which required additional work consisting of exploratory excavation to identify the obstructions, protection of the excavation using barriers and dewatering, removal of excess materials off site, and backfilling and compaction of the excavated areas. The contractor submitted a cost proposal (CO-6) for an extra in the amount of $244,684.49 and a credit in the amount of $0.00, for a net extra in the amount of $244,684.49. The engineer reviewed the proposal, found it to be unreasonable, and submitted a counterproposal for an extra in the amount of $237,357.70 and a credit in the amount of $0.00, for a net extra in the amount of $237,357.70, which was accepted by the contractor and stated, via correspondence CO6, that the Engineering Department would recommend its approval.
Item 2: An extra in an amount of $351,263.68 is requested for custom-made adapter plates on the aeration tank drain gates. The engineer has determined that certain revisions are required to the original scope of work for the installation of sluice gates for the Battery A Aeration Tank drains. The revisions are necessary because the existing conditions were not accurately represented in the as-built documents for the installation of the new sluice gates. The existing gates were installed in the 1930s, and their configuration presents mounting and access limitations that require a custom-made adapter plate. The existing wall flange is recessed within the tank wall, preventing direct mounting of a new standard flange-mounted gate. Additionally, the limited clearance between the drain pit walls and the existing gate restricts access to the flange bolts required to secure the new gates. The custom-made adapter plate will accommodate these existing conditions and provide the necessary interface for installation of the new sluice gates. A credit is also included for eight floor boxes that will not be installed for eight of the existing 12-inch sluice gates because the gate stems extend upward outside the walkway areas, eliminating the need for floor boxes at these locations. The contractor submitted a cost proposal (CO-7) for an extra amount of $358,153.29 and a credit in the amount of $6,889.61, for a net extra of $351,263.68. The engineer reviewed the proposal, found it to be reasonable, and stated via correspondence CO7, that the Engineering Department would recommend its approval.
The above two change orders are in compliance with the Illinois Criminal Code since the changes are due to circumstances not reasonably foreseeable at the time the contract was signed and are in the best interest of the District.
It is hereby recommended that the Board of Commissioners authorize the Director of Procurement and Materials Management to execute these change orders to increase Contract 08-174-3D in an amount of $588,621.38 (1.02% of the current contract value), from an amount of $57,686,617.09, to an amount not to exceed $58,275,238.47.
Funds are available in Account 401-50000-645750.
Requested, Catherine A. O’Connor, Director of Engineering, CS:GRR:JJ

Respectfully Submitted, Precious Brady-Davis, Chairperson Committee on Procurement
