TRANSMITTAL LETTER FOR BOARD MEETING OF APRIL 17, 2025

COMMITTEE ON JUDICIARY

Mr. John P. Murray, Acting Executive Director

Title.

Authority to settle the Workers’ Compensation Claims of James Radomski vs. MWRDGC, Claim number 23WC018401, Illinois Workers’ Compensation Commission (IWCC), in the sum of $275,000.00, Account 901-30000-601090

Body

Dear Sir:

James Radomski is a Police Officer assigned to the Stickney Water Reclamation Plant. On February 19, 2022, he reported that he injured his right shoulder and right side when he slipped and fell on ice while walking to his personal vehicle in the Stickney parking lot. Mr. Radomski sought treatment at LaGrange Hospital and was taken off work on February 20, 2022.

He had an MRI of the right shoulder, which revealed a traumatic rotator cuff injury. Mr. Radomski had surgery on April 20, 2022. He began experiencing numbness in his right hand. Initially, this was attributed to Carpel Tunnel Syndrome, however when the pain did not subside, Mr. Radomski had a cervical MRI and was referred to a spine surgeon.

Mr. Radomski was released to return to full duty work effective November 30, 2022, for the shoulder injury. However, he did not return to work at that time.

Mr. Radomski had a two-level cervical fusion on December 12, 2022. An Independent Medical Exam had previously determined that medical evidence did not support a relationship between Mr. Radomski’s cervical issues and his slip and fall accident. The cervical injury is disputed.

The employee received Police Duty Disability benefits for lost time related to the accepted shoulder injury, representing a total of 40.60 weeks.

Mr. Radomski has filed an Application of Adjustment of Claims with the Illinois Workers’ Compensation Commission (IWCC) through his counsel.  Subject to the approval of the IWCC, this claim can now be settled for $275,000.00. This settlement includes a separate resignation and release of all claims against the District. In addition, this settlement closes out any future lost time and future medical benefits associated with these injuries.

The Director of Human Resources believes this settlement is in the best interest of the District and requests payment of that sum be approved, and he be authorized to execute such documents as may be necessary to effect the settlement.

Requested, Thaddeus J. Kosowski, Director of Human Resources, TJK:BLW:DMG

Disposition of this agenda item will be documented in the official Regular Board Meeting Minutes of the Board of Commissioners for April 17, 2025
