Request for authority to negotiate a service agreement with the Village of Hoffman Estates and the Metropolitan Water Reclamation District for an area lying outside the District but within Cook County, Autumn Woods Subdivision

Dear Sir:

 

The Engineering Department is in receipt of a letter dated December 21, 2007, from the Village of Hoffman Estates (Village) requesting sanitary sewer service from the Metropolitan Water Reclamation District (District) for a contiguous area within the Village and Cook County but outside the corporate limits of the District.  The area under consideration, proposed Autumn Woods Subdivision, will consist of 39.639 acres (Exhibit A attached) located north of Summit (Golf) Road and east of Berner Drive.

 

The property to be served will consist of a residential development of approximately 75 single-family homes.  The Village has indicated that its system has the capacity to serve the proposed development and that it will allow connection.

 

The Engineering Department requests authority to negotiate a Service Agreement with the Village of Hoffman Estates to provide the requested service for the aforesaid area.

 

The following terms and conditions will be included in the Service Agreement to be negotiated:

 

1.                     The District will receive an annual fee based on 140 percent of the tax rate now levied within the District’s boundaries, multiplied by the equalized assessed valuation of the property covered by the Service Agreement. This base fee will apply through April 30, 2009.  A 10 percent incremental increase will take effect on May 1, 2009, and successively each April 1 thereafter, until the property is annexed to the District.

 

2.                     The District will receive a one-time, non-refundable fee of $1,500.00, to be paid with the submittal of the signed Service Agreement by the Village after the Board grants authority to execute the Service Agreement.

 

3.                     The District will be paid Connection Impact Fees in accordance with the Sewer Permit Ordinance at the rate of $3,750.00 per acre for residential developments.

 

4.                     The Village, at its sole expense, will promptly undertake the necessary steps for annexation of the area into the District.

 

5.                     The Village shall construct or cause to be constructed, at no cost to the District, all sanitary sewers and appurtenances necessary to serve the area.

 

6.                     Unpaid charges will be subject to a five percent penalty on the unpaid balance. All overdue payments, including penalties, will be subject to an interest charge of one and one-half percent per month on the unpaid balance.

 

7.                     The Village, at its sole expense, will obtain all necessary approvals from IEPA, CMAP (formally NIPC) and other agencies as applicable, including necessary amendments to the MWRD-related Facility Planning Area as required.

 

8.                     Other conditions necessary to protect the interests of the District and ensure the orderly development of the area will be included in the Service Agreement.
