Dear Sir:
 
On December 15, 2011, the Board of Commissioners authorized the Director of Procurement and Materials Management to advertise for bids, 12-360-11 Proposal to Lease for Ten (10) Years Approximately 5.45 Acres of Real Estate Located Along the North Side of Canal Bank Road in Forest View, Cook County, Illinois; Main Channel Parcel 38.11 (Portion).
 
In response to a public advertisement of January 25, 2012, a bid opening was held on February 14, 2012.  The bid tabulation for this contract is:
 
TOWN AND COUNTRY TRANSFER, LLC      $75,000.00
 
One hundred fifty (150) companies were notified of this contract being advertised and four (4) companies requested specifications.
 
A review of the proposal submitted by Town and Country Transfer, LLC, revealed that on page P-1 of the proposal, the bidder conditioned their bid requiring an abatement of 100 percent of the easement fee due under another easement.  The District cannot accept bids that take exception to the terms and conditions as stated on page R-2 of the contract documents.  Therefore, the bid is considered non-responsive and rejected in the public's best interest.  The Director of Procurement and Materials Management has notified Town and Country Transfer, LLC, of this action.
 
The Law Department will re-advertise this contract at a later date.
