Dear Sir:

 

On March 5, 2015, the Board of Commissioners authorized the District to negotiate an intergovernmental agreement (IGA) with the Village of Northbrook (Village) to allow the District to contribute $475,000.00 towards installation of an electronic control system and an irrigation system for an underground storage vault. The Village is constructing a 23 acre-foot (approximately 7.5 million gallons) stormwater storage vault under Wescott Park to address long term flooding issues. The project will provide a 25-year storm event level of protection. The Village is investing $10.3 million into this project and requested the District to contribute $475,000.00 towards installation of an electronic control system and an irrigation system.

 

The District and the Village agreed in principle to the terms of the IGA, which include payment by the District of construction costs for the captioned project in an amount not to exceed $475,000.00. Partial payments to the Village will be made at predefined intervals during construction, which is anticipated to commence in 2016. The IGA requires project-related construction contracts, paid with District funds, to comply with the District’s Purchasing Act, Multi-Project Labor Agreement, and Affirmative Action Requirements.  The Village will assume responsibility for design, construction, perpetual maintenance, and operation of these improvements and will be solely responsible for any change orders to the project. The IGA contains provisions which allow the District to review the project’s design and perform inspections during and after construction. The District will seek credit for this project under the Green Infrastructure requirements of the Consent Decree, subject to the approval of the Environmental Protection Agency.

 

For your information, the IGA was inadvertently circulated for execution by the District earlier this year prior to seeking authority from the Board of Commissioners. No action has been taken by the District on the IGA. If the Board approves this request, the IGA will be re-circulated for execution.

 

Based on the foregoing, it is requested that the Board of Commissioners grant authority to enter into an IGA with the Village and make payment to the Village in an amount not to exceed $475,000.00. 

 

Funds are available in Account 401-50000-612400.
