Dear Sir:

 

On November 20, 2020, the Board of Commissioners authorized the Director of Procurement and Materials Management to advertise for bids Contract 21-348-11, Services to Remove Hazardous Materials from Various District Locations, On an As-Needed Basis, For A Three-Year Period.

 

In response to a public advertisement of February 3, 2021, a bid opening was held on March 16, 2021. The sole bidder was rejected as reported at the Board Meeting of April 1, 2021.

 

In response to a public re-advertisement of April 21, 2021, a bid opening was held on May 11, 2021. The bid tabulation for this contract is:

 

                     LUSE ENVRIONMENTAL SERVICES, INC.                     $252,997.50

 

The Director of Procurement and Materials Management has reviewed the bidders’ list for this contract and is satisfied that the market for this service has been adequately solicited.  A planholders’ survey revealed the following reason for not bidding:  could not provide a bid at this time.  In light of these findings, the Director of Procurement and Materials Management is of the opinion that the bid received is a fair and reasonable price, and nothing would be gained by rejecting the sole bid and re-advertising this contract.

 

Luse Environmental Services, Inc., the sole bidder, is proposing to perform the contract in accordance with the specifications.  The estimated cost for this contract is $230,000.00, placing the bid of $252,997.50, approximately 10 percent above the estimate.

 

Luse Environmental Services, Inc., has executed the Multi-Project Labor Agreement (MPLA) certificate as required.  It is anticipated that the following trades will be utilized on this contract:  laborers.  The list of trades is not intended to confer any rights or jurisdiction upon any union or unions.

 

The contract will require approximately four (4) people for the services.

 

Luse Environmental Services, Inc., is in compliance with the Affirmative Action Ordinance, Revised Appendix D and Appendix V as indicated on the attached report.  The Minority Business Enterprise (MBE), Women Business Enterprise (WBE), Small Business Enterprise (SBE) and Veteran-Owned Business Enterprise (VBE) utilization goals for this contract are 20 percent MBE, 10 percent WBE, and bidder offers WBE credits to satisfy SBE participation.  Bidder provided a waiver for the VBE goal.

 

In view of the foregoing, it is recommended that the Director of Procurement and Materials Management be authorized to award Contract 21-348-12 (Re-Bid) to Luse Environmental Services, Inc., in an amount not to exceed $252,997.50, subject to the contractor furnishing a performance bond in form satisfactory to the Law Department and approved by the Director of Procurement and Materials Management.

 

The contractor will commence work after the approval of the Contractor’s Bond and continue until December 31, 2023.

 

Funds for the 2021 expenditure, in the amount of $70,000.00, are available in Account 101-25000-612780.  The estimated expenditures for 2022 are $91,498.75 and for 2023 are $91,498.75.  Funds for the 2022 and 2023 expenditures are contingent on the Board of Commissioners’ approval of the District’s budget for those years.
