TRANSMITTAL LETTER FOR BOARD MEETING OF JUNE 19, 2008

COMMITTEE ON JUDICIARY

Mr. Richard Lanyon, General Superintendent

Title

Payment of the Award in the Workers’ Compensation Claim of Thomas Morrissey vs. MWRDGC, 06WC 33639, Illinois Workers’ Compensation Commission in the sum of $39,213.10.  Account 901-30000-601090

Body

Dear Sir:

Thomas Morrissey is a Laborer at the Stickney Water Reclamation Plant.  On July 20, 2006, while cleaning underneath the conveyor in the fine screen building, his right arm got caught in the conveyor belt.  Morrissey went to MacNeal Hospital and was diagnosed with a fracture of the distal humerus and a deep laceration of the right forearm.  On July 24, 2006, he underwent surgical debridement and skin grafting of the right forearm.  He developed a right shoulder adhesive capsulitis and impingement that was treated with an injection and therapy.  He lost 118 days of work.

Morrissey filed an Application for Adjustment of Claim being Case No. 06WC 33639 with the Illinois Workers’ Compensation Commission (IWCC).  The case was tried before Arbitrator Charles Devriendt of the IWCC and on May 15, 2008 a decision was filed awarding Morrissey the sum of $39,213.10, which represents a 25% loss of use of the right arm.

The Attorney believes this is an equitable sum and requests payment of the Award be approved and he be authorized to execute the proper documents necessary to effect the settlement

Requested, Frederick M. Feldman, Attorney, FMF:LAG:VMM:lrr

Respectfully Submitted, Terrence J. O’Brien, Chairman Committee on Judiciary
