Dear Sir:

 

On March 15, 2007, the Board of Commissioners passed an order authorizing the Purchasing Agent to advertise for bids for Contract 02-110-2E Electrical Distribution System and Conduit and Cable Replacement.

 

In response to a public advertisement of September 26, 2007, a bid opening was held on March 25, 2008.  The bid tabulation for this contract is:

 

ELECTRICAL SYSTEMS, INC.                     $7,469,000.00

DIVANE BROS. ELECRIC CO.                     $7,707,000.00

BROADWAY ELECTRIC, INC.                     $7,991,000.00

M.G. ELECTRIC SERVICE CO.                     $8,820,000.00

GIBSON ELECTRIC CO., INC.                     $8,871,750.00

WINDY CITY ELECTRIC CO.                     $9,500,000.00

                                                                                    

Six hundred thirty-four (634) companies were notified of this contract being advertised and fifteen (15) companies requested specifications.

 

The PCE Utilization goals for this contract are 13 percent MBE, 7 percent WBE, and 10 percent SBE.  Electrical Systems, Inc., offered PCE goals of 11 percent MBE, 8 percent WBE and offered MBE and WBE participation to meet the SBE goal.  A review by the Affirmative Action Administrator revealed that Electrical Systems, Inc., did not meet the 13 percent MBE goal and did not request a wavier for the shortfall in their Utilization Plan.  Based on the above information, the Purchasing Agent has informed Electrical Systems, Inc., that their bid is considered non-responsive and rejected.

 

Divane Bros. Electric Co., the lowest responsible bidder, is proposing to perform the contract, in accordance with the specifications.  The estimate for the contract was $8,523,370.00, placing the bid of $7,707,000.00, approximately 9.5 percent below the cost estimate.

 

The bidder is in compliance with the Revised Appendix D as indicated on the attached report.  The protected class utilization for this contract is 13 percent MBE, 7 percent WBE, and the Contractor offers MBE and WBE credits to fulfill the SBE goal of 10 percent.

 

Divane Bros. Electric Co., has executed the Multi-Project Labor Agreement certificate as required.  The trades anticipated to be utilized on the contract are Electricians, Carpenters, Sheetmetal Workers, Hoisting Engineers, Insulators, and Pipefitters.  The list of construction trades is not intended to confer any rights or jurisdiction upon any union or unions.

 

In view of the foregoing, it is recommended that the Purchasing Agent be authorized to award Contract 02-110-2E to Divane Bros. Electric Co., in an amount not to exceed $7,707,000.00, subject to the contractor furnishing a performance bond in form satisfactory to the Law Department and approved by the Purchasing Agent.  Funds are available in Accounts 201-50000-645780, 645750, 645700.
