Dear Sir:

 

On June 2, 2022, the Board of Commissioners authorized the Director of Procurement and Materials Management to advertise for bids, Contract 23-665-11, Landscape Maintenance at Various Service Areas.

 

In response to a public advertisement of September 14, 2022, a bid opening was held on October 11, 2022. The bid tabulation for this contract is:

The Affirmative Action Ordinance, Revised Appendix D goals for this contract are 20 percent Minority Business Enterprise (MBE), 9 percent Women Based Enterprise (WBE), 10 percent Small Business Enterprise (SBE) and 3 percent Veteran-owned Business Enterprise (VBE). 

 

Lewis Lawn Service, Inc. (Lewis) submitted a utilization plan and the participation offered was: 20% MBE, 0% WBE, bidder offered MBE participation for the SBE goal and no participation for the VBE goal. Bidder requested a waiver for the WBE participation.

 

The Diversity Administrator reviewed the utilization plan that Lewis submitted for Group A and D of the contract and determined that they are not in compliance with the requirements of the Affirmative Action Ordinance Revised Appendix D. Lewis did not substantiate good faith efforts under Section 12 (e), Utilization Plan Submission and should not be granted a waiver for the WBE goal. 

 

In addition, Lewis Lawn Service, Inc. indicated that they cannot comply with the Multi-Project Labor Agreement (MPLA) because they are not a union shop and do not intend to become part of any union.

 

A review by the Maintenance and Operations Department indicated that Lewis Lawn Service, Inc. does not comply with the specifications of the contract for Groups A and D.  Lewis Lawn Service, Inc., does not possess a current commercial pesticide applicator license issued by the State of Illinois as required under CONTRACTOR QUALIFICATIONS on page DS-3.  Additionally, Lewis Lawn Service, Inc., was unable to verify a minimum of three (3) years of landscape experience at facilities that are comparable in size and in landscape tasks specified in the contract as required under CONTRACTOR QUALIFICATIONS on page DS-3.

 

Therefore, the bid submitted by Lewis Lawn Service, Inc., is deemed non-responsive and rejected for failure to comply with the Affirmative Action Ordinance, Revised Appendix D, the Multi-Project Labor Agreement and requirements on license and experience, and it is in the public’s best interest. The Director of Procurement and Materials Management has notified Lewis Lawn Service, Inc. of this action.

 

There were no bids received for Group B and C.

 

The Maintenance and Operations Department will review the contract prior to any re-advertisement.
