Authority to grant to the County of Cook a 75-year, .43± acre non-exclusive easement to construct, install, operate, maintain, repair, and remove a public road across North Shore Channel Parcels 1.08 and 1.11, north of Isabella Street and east of the CTA railroad tracks in Wilmette and Evanston, Illinois.  Consideration shall be a nominal fee of $10.00

Dear Sir:

 

The County of Cook (“County”) has requested a 75-year, .43± acre non-exclusive easement to construct, install, operate, maintain, repair, and remove a public road across North Shore Channel Parcels 1.08 and 1.11, north of Isabella Street and east of the CTA railroad tracks in Wilmette and Evanston, Illinois.  The County is seeking the easement in order to provide public access to privately owned property.  The County has previously requested similar easements for access to this private property, however this request by the County is for the specific purpose of providing access to the development of affordable housing by the Housing Opportunity Development Corporation, the contract purchaser of the private property.

 

Parcel 1.08 is under lease to the Wilmette Park District (“Wilmette”) and Parcel 1.11 is under lease to the City of Evanston (“Evanston”).  Both Evanston and Wilmette sublease their respective leaseholds to the Evanston-Wilmette Golf Course Association, d/b/a Canal Shores Golf Course, for use as a public golf course.  The leases allow the District to grant easement rights on any portion of the leaseholds required for the construction of roadways, or adjuncts thereto, for the use of any governmental agency engaged in the construction of roadways or adjuncts thereto.

 

The Wilmette lease commenced May 6, 1965, and expires May 31, 2032.  The annual rent is $700.00.  The Evanston lease commenced October 14, 1966, and expires May 31, 2032.  The annual rent is $1,300.00, plus 25% of the annual net income from the operation of the golf course, municipal parking lot, and Evanston-sponsored festivals and concerts. The District also receives 25% of annual gross income derived from public parking and tailgating activities in the Evanston portion of the leasehold, subject to a minimum of $80,000.00 per year.

 

The technical departments have reviewed this request and have no objections thereto.  A nominal fee of $10.00 is recommended as is customary with governmental entities that use District land for public purposes.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it grant to the County of Cook a 75-year approximately .43± acre non-exclusive easement to construct, install, operate, maintain, repair, and remove a public road across North Shore Channel Parcels 1.08 and 1.11, north of Isabella Street and east of the CTA railroad tracks in Wilmette and Evanston, Illinois.  Consideration shall be a nominal fee of $10.00

 

It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute said easement agreement after it is approved by the General Counsel as to form and legality.
