Authority to grant West Shore Pipeline Company a 25-year, approximately 77,070 sq. ft. non-exclusive easement to continue to access, operate, maintain, repair, reconstruct, and remove a 16-inch petroleum products pipeline located on District real estate near the confluence of the Chicago Sanitary and Ship Canal and the Cal-Sag Channel on portions of Main Channel Parcels 26.02, 26.03, and 26.07, in Cook County and DuPage County, Illinois. Consideration shall be an initial annual fee of $15,070.00

Dear Sir:

 

West Shore Pipeline Company (“West Shore”) operates and maintains a 16-inch diameter petroleum products pipeline that traverses District real estate located near the confluence of the Chicago Sanitary and Ship Canal and the Cal-Sag Channel in Cook County and DuPage County, Illinois. The existing easement for the pipeline, which comprises approximately 77,070 sq. ft., commenced October 3, 2001, and expires October 4, 2026. The current annual easement fee is $9,124.87.

 

West Shore has requested a new 25-year easement to continue to operate and maintain the pipeline. The easement traverses portions of Main Channel Parcels 26.02 and 26.03, which the District leases to IMTT-Illinois, LLC, and a portion of Main Channel Parcel 26.07, which the District leases to the DuPage County Forest Preserve District. These tenants have no objection to the renewal of West Shore’s easement.

 

The District’s technical departments have reviewed West Shore’s request and have no objections thereto. An initial annual easement fee of $15,070.00 is recommended, which represents 10% of the pro-rata share of the easement premises’ appraised fair market value.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize the District to grant West Shore Pipeline Company a 25-year, approximately 77,070 sq. ft. non-exclusive easement to continue to access, operate, maintain, repair, reconstruct, and remove a 16-inch petroleum products pipeline located on District real estate near the confluence of the Chicago Sanitary and Ship Canal and the Cal-Sag Channel on portions of Main Channel Parcels 26.02, 26.03, and 26.07, in Cook County and DuPage County, Illinois. Consideration shall be an initial annual fee of $15,070.00.

 

It is further requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute said easement agreement after it is approved by the General Counsel as to form and legality.
