Dear Sir:
On October 17, 2019, the Board of Commissioners authorized the Director of Procurement and Materials Management to advertise for bids, Contract 20-655-11 Manhole and Infrastructure Repairs.
In response to a public advertisement of January 8, 2020, a bid opening was held on February 11, 2020. The bid tabulation for this contract is:

The quantities specified in the contract documents were used for the purpose of comparing bids and establishing unit prices. The total amount to be expended on this contract, should usage differ from the quantities, is not to exceed $600,000.00.
The associated goals for this contract are 17% Minority Business Enterprise (MBE), 6% Women Business Enterprise (WBE), 10% Small Business Enterprise (SBE), and 3% Veteran-Owned Business Enterprise (VBE).
The Diversity Administrator’s review of the low bid submitted by Ed Weathersby & Sons Plumbing, Water & Sewers, Inc. (“Weathersby”) revealed that they are not in compliance with the Affirmative Action Ordinance Revised Appendix D. Weathersby did not submit with its Utilization Plan any designation of MBE or SBE participation and did not include a signed Waiver Request Form for the shortfall in the requirements of MBE and SBE goals. In addition, Weathersby has failed to complete and include the VBE Commitment Form. Therefore, the bid was considered non-responsive and rejected in accordance with Section 12(a) and (c) of the Affirmative Action Ordinance Revised Appendix D. The Director of Procurement and Materials Management concurs with the Diversity Administrator and has informed Ed Weathersby & Sons Plumbing, Water & Sewers, Inc., of this action.
Sumit Construction Co., Inc., the lowest responsible bidder, is proposing to perform the contract in accordance with the specifications. The estimated cost for the contract was $600,000.00, placing their bid of $555,655.00 approximately 7.4 percent below the estimate.
Sumit Construction Co., Inc., has executed the Multi-Project Labor Agreement (MPLA) certificate as required. It is anticipated that the following construction trades will be utilized on this contract: laborers, carpenters, cement finishers/brick masons and equipment operators. The list of construction trades is not intended to confer any rights or jurisdiction upon any union or unions.
The contract will require approximately three (3) people for the services.
Sumit Construction Co., Inc., is in compliance with the Affirmative Action Ordinance, Revised Appendix D, as indicated on the attached report. The Minority Business Enterprise (MBE), Women Business Enterprise (WBE), and Small Business Enterprise (SBE) utilization goals for this contract is 6 percent WBE and the bidder offers itself to satisfy MBE and SBE participation. The bidder submitted Good Faith Efforts for VBE participation.
In view of the foregoing, it is recommended that the Director of Procurement and Materials Management be authorized to award Contract 20-655-11 to Sumit Construction Co., Inc., in an amount not to exceed $600,000.00, subject to the contractor furnishing a performance bond in form satisfactory to the Law Department and approved by the Director of Procurement and Materials Management.
The contract will commence upon approval of the Contractor’s Bond and terminate on December 31, 2021.
Funds for the 2020 expenditures, in the amount of $289,957.40, are available in Account 101-66000-612600. The estimated expenditures for 2021 are $310,042.60. Funds for the 2021 expenditures are contingent on the Board of Commissioners’ approval of the District’s budget for that year.
