Title
Authorize the Village of Worth to conduct its annual Worth Days festival from August 9-12, 2012, on approximately 20 acres of its leasehold property located at 115th Street and Oketo Avenue in Worth, Illinois, Cal-Sag Channel Parcel 8.06. Consideration shall be a nominal fee of $10.00.

Dear Sir:
The Law Department has received a request from the Village of Worth ("Village") for permission to conduct its annual Worth Days community festival on approximately 20 acres of its leasehold property located at 115th Street and Oketo Avenue in Worth, Illinois, Cal-Sag Channel Parcel 8.06, from August 9-12, 2012.
The Village leases approximately 214.10 acres of District land on Cal-Sag Channel Parcels 8.06 and 9.03 under a 39-year lease that commenced on June 1, 1996 and expires on May 31, 2035. The land is used for a golf course, driving range, parking lot, and other public recreational facilities.
Approval for use of a 20 acre section of the leasehold for the annual Worth Days event, including the sale of alcoholic beverages, has been granted by the District since 2004. The Worth Days Annual Community Festival includes activities such as carnival rides, concession stands, fireworks display, and a beer garden. The subject property falls within the requirement of Illinois Statute 235 ILCS 5/6-15 permitting the sale and consumption of alcohol on District-owned land only if approved by of the District's Board of Commissioners when it is leased for a term of at least 20-years. Procurement of dram shop insurance will be required.
The District's technical departments have no objections to the Village using the site for this purpose. The Village will be required to add the District, its Commissioners, officers, agents, and employees as additional insureds to its dram shop coverage.
It is requested that the Executive Director recommend to the Board of Commissioners that it authorize the Village of Worth to conduct its annual Worth Days festival from August 9-12, 2012, on approximately 20 acres of its leasehold property located at 115th Street and Oketo Avenue in Worth, Illinois, Cal-Sag Channel Parcel 8.06, subject to the terms set forth herein. Consideration shall be a nominal fee of $10.00.
