Dear Sir:

 

William J. Kelly, Jr. is a Pipefitter at the Stickney Water Reclamation Plant.  He underwent two epidural steroid injections, physical therapy and work conditioning for a low back injury that occurred on December 13, 2005.  On April 3, 2008, the Board of Commissioners approved a settlement of $14,794.25 for this pro se claim, which represented a 5% loss of the person as a whole.

 

Arbitrator Robert Lammie of the Illinois Workers’ Compensation Commission rejected the settlement and recommended the claim be settled for $22,191.38 which represents a 7.5% loss of the person as a whole.  Although the Attorney believes this amount to be on the high end of settlement value for this type of injury, he recommends the District increase our offer in this case to avoid the long delay and added costs of litigation for the employee and the District.

 

The Attorney requests payment of the additional $7,397.13 be approved and he be authorized to execute such documents as may be necessary to effect the settlement.
