Dear Sir:

 

Alberto Saenz is a Machinist at the Stickney Water Reclamation Plant. On December 6, 2022, he reported that he felt a pop in his left shoulder while picking up metal scraps and throwing them into a front loader. He sought treatment at the Industrial Clinic on December 22, 2022, and was diagnosed with a left shoulder strain. He treated conservatively with physical therapy.

 

Mr. Saenz continued to have pain. An MRI revealed a labral SLAP tear in the left shoulder. He had surgery on July 3, 2023, and was taken off work at that time. Mr. Saenz returned to work on October 2, 2023.

 

Mr. Alberto Saenz was paid 13.0 weeks of lost time benefits totaling $17,939.09.

 

Mr. Saenz filed an Application of Adjustment of Claim with the Illinois Workers’ Compensation Commission (IWCC) through his counsel. Subject to the approval of the IWCC, this case can be settled for $74,851.50 representing approximately 15.0% loss of a person as a whole. This settlement will close out any future lost time and medical benefits.

 

The Director of Human Resources believes this settlement is in the best interest of the District and requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.
