Dear Sir:

 

On April 16, 2020, the Board of Commissioners authorized the Director of Procurement and Materials Management to award Contract 13-248-5F, Streambank Stabilization Project on Melvina Ditch in Oak Lawn and Chicago Ridge, CSA, to Rausch Infrastructure, L.L.C., in an amount not to exceed $9,847,000.00, plus a five (5) percent allowance for change orders in an amount of $492,350.00, for a total amount not to exceed $10,339,350.00. The contract was substantially completed on June 24, 2022.

 

As of July 14, 2023, the attached list of change orders has been approved.

During the bid period for Contract 13-248-5F, the contractor asked if the District had information regarding flow rates in Melvina Ditch in an attempt to size an appropriate dewatering system for the creek. The District responded that flows in the creek were an annual average of 4 cubic feet per second (cfs), primarily dictated by intermittent operation of two 7.8 cfs dewatering pumps at the upstream Melvina Ditch Reservoir. Following the bid period and under a separate contract, the District replaced existing pumps at the Melvina Ditch Reservoir with upsized 9.8 cfs pumps. During the duration of construction, the contractor was required to increase the capacity of their as-bid dewatering system to bypass stream flows from the upstream reservoir. The contractor submitted a cost proposal (COR-21) for an extra in the amount of $55,862.66 for an upsized pumping system and a credit for the as-bid pumping system in the amount of $20,394.80, for a net extra in an amount of $35,467.86. The engineer reviewed the proposal, found it acceptable, and recommends its approval.

 

This change order is in compliance with the Illinois Criminal Code since the change is due to circumstances not reasonably foreseen at the time the contract was and is in the best interest of the District.

 

It is hereby recommended that the Board of Commissioners authorize the Director of Procurement and Materials Management to execute a change order to increase Contract 13-248-5F in an amount of $35,467.86 (0.30 percent of the current contract value), from an amount of $11,969,547.79 to an amount not to exceed $12,005,015.65.

 

Funds are available in Account 501-50000-645720.
