Dear Sir:

 

In connection with the captioned project, it is necessary to acquire a license for the grout curtain from the CSX Transportation, a Virginia Corporation (CSXT) for the construction, operation and maintenance of a grout curtain to accommodate the construction of the project.

 

The permanent grout curtain will be constructed through property owned by CSXT, and will be in operation for the life of the Thornton Composite Reservoir.

 

The consideration for the acquisition of the license from CSXT is $750.00, and is based on CSXT’s cost for adding the captioned project to CSXT’s railroad protective liability policy for each period of activity.

 

It is  requested that the Executive Director recommend to the Board of Commissioners that it accept and approve the license for the grout curtain from CSXT to the District in connection with the captioned project.

 

It is further requested that the Executive Director recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said license from CSXT on behalf of the District after it is approved by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.

 

Funds are available in Account 401-50000-667340.
