Authorization is requested to enter into an Intergovernmental Agreement (IGA) with and make payment to County of Cook acting through its Department of Transportation and Highways (County) and the City of Oak Forest (City) for the design, construction, operation and maintenance of the Culvert Upsizing and Channel Improvements on Boca Rio Ditch in Oak Forest, Illinois under Phase II of the Stormwater Management Program, in an amount not to exceed $810,000.00.
On May 17, 2018, the Board of Commissioners authorized the District to negotiate IGAs to assist various local municipalities and other governmental organizations with stormwater projects under the Local Stormwater Partnership Program, including the County. Under this project, the County proposes to construct channel improvements at various locations along Boca Rio Ditch and replace an existing culvert at 151st Street and Boca Rio Drive, as depicted in the attached exhibit. Upon completion of these improvements, the project will provide flood reduction benefits to an estimated 28 residential structures and enhance water quality along Boca Rio Ditch.
The District, the County, and the City have agreed in principle to the terms of the IGA, which include payment by the District to the County towards construction costs in an amount not to exceed $810,000.00. The total project cost, including design and permitting of all stormwater improvements to be undertaken by the County is $1,225,517.02. Partial payments to the County will be made at predefined intervals during construction, which is anticipated to commence in May 2023. The County and the City have contributed to engineering and other design-related costs of the project. The County will assume responsibility for construction of the project and be solely responsible for any change orders. The maintenance and operation of the project will be performed by the County and the City, within their respective jurisdictional limits. The IGA contains provisions which allow the District to review the project’s design and perform inspections after construction.
The County indicated during the negotiations for this agreement that it would prefer to use their standard contract requirements for this project since they are administering the construction contract. These requirements include advertising and awarding construction contracts in conformance with the Cook County Procurement Code, Cook County Public Works Minority- and Women-Owned Business Enterprise Ordinance, and the Prevailing Wage Act. The County’s tailored goals for this project to be applied to the entire construction contract are 24 percent for Minority-owned Business Enterprises and 10 percent for Women-owned Business Enterprises, and a preference of five percent for Veteran-owned Business Enterprises.
In keeping with the Board’s request to receive summary reports documenting the attainment of diversity goals across District stormwater partnerships, the County will be required to provide information on the attainment of its diversity goals for this project, which will be included in the summary report to be submitted to the Board on an annual basis.
Based on the foregoing, it is requested that the Board of Commissioners grant authority to enter into an IGA with and make payment to the County of Cook in an amount not to exceed $810,000.00. It is further requested that the Chairman of the Committee on Finance, Executive Director and Clerk be authorized to execute said agreement on behalf of the District, as well as any documents necessary to effectuate the transaction and conveyance, upon approval by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.
Funds are being requested in 2023 in Account 501-50000-612400, and are contingent upon the Board of Commissioners’ approval of the District’s budget for that year.
