Title
Consent to an assignment of easement from Sigecom, LLC, d/b/a WOW! Internet, Cable and Phone, to MCImetro Access Transmission Services Corp., d/b/a Verizon Access Transmission Services, to construct, install, operate, maintain, repair and remove an aerial and underground fiber optic cable on portions of Main Channel Parcels 29.02 and 29.04 in Willow Springs, Illinois. Consideration shall be a document preparation fee of $5,000.00

Dear Sir:
On January 21, 2016, the Board of Commissioners authorized the District to grant a 25-year, 1,658’ x 10’ non-exclusive easement to Sigecom, LLC, d/b/a WOW! Internet, Cable and Phone (WOW!”), to construct, install, operate, maintain, repair and remove an aerial and underground fiber optic cable on portions of District Main Channel Parcels 29.02 and 29.04 in Willow Springs, Illinois. The easement expires January 31, 2041. WOW!’s current annual easement fee is $5,040.00. The easement allows WOW! to assign the easement subject to the District’s written consent.
WOW! recently sold its fiber optic cable network in the Chicagoland area to MCImetro Access Transmission Services Corp., d/b/a Verizon Access Transmission Services (“MCImetro”), including WOW!’s interest in the above-referenced easement. In connection with the sale, WOW! is requesting the District’s consent to the assignment of the easement from WOW! to MCImetro.
The District’s Finance Department has reviewed the MCImetro’s financial and company background information and reports that MCImetro has the financial resources to meet the annual fee obligation under the easement.
It is requested that the Executive Director recommend to the Board of Commissioners that it consent to an assignment of easement from Sigecom, LLC, d/b/a WOW! Internet, Cable and Phone, to MCImetro Access Transmission Services Corp., d/b/a Verizon Access Transmission Services, to construct, install, operate, maintain, repair and remove an aerial and underground fiber optic cable on portions of Main Channel Parcels 29.02 and 29.04 in Willow Springs, Illinois. Consideration shall be a document preparation fee of $5,000.00.
It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute the Consent to Assignment of Easement Agreement after it is approved by the General Counsel as to form and legality.
