Authorization is requested to negotiate and enter into an Intergovernmental Agreement (IGA) with and make payment to the Board of Education of School District 103 (SD 103) and the Village of Lyons (Village) for the design, construction, operation, and maintenance of the School District 103 Green Infrastructure Project in Lyons (25-IGA-12), in an amount not to exceed $386,100.00.

 

As detailed in a Report on Green Infrastructure (GI) Project Submittals presented to the Board of Commissioners on May 1, 2025, between September 2025 and March 2025 the District solicited GI project proposals from municipalities, townships, and other governmental agencies for District assistance, and received 21 applications. Of the 21 project applications received, the Engineering Department identified 15 projects to recommend for advancing through partnerships based on the anticipated funding available in 2026 for the District’s stormwater management program, including the subject project.

 

The proposed project will construct a permeable parking lot with permeable pavers in the place of two apartment buildings that were previously purchased and demolished by SD 103, as depicted in the attached exhibit. The project is expected to help mitigate flooding in the project area and demonstrate to local residents the benefits of constructing GI. The project will reduce and attenuate stormwater runoff in the vicinity of the project area and the gallons of stormwater storage constructed will be included in the District’s annual reporting to the United States Environmental Protection Agency for the GI portion of the District’s consent decree.

 

The terms of the IGA will include payment by the District towards construction costs based on the total Designed Retention Capacity (DRC), or stormwater storage, that the project provides. District funding will be provided at a fixed rate per gallon of DRC and capped at an amount not to exceed $376,100.00. The District retains the discretion to adjust the amount of its reimbursement based on the project’s final constructed DRC. Additionally, the District is providing separate funds, to be available if needed, to assist with environmental site assessment services in an amount not to exceed $10,000.00. The total project cost, including design and permitting, is estimated to be $1,645,860.00. Partial payments to SD 103 and the Village, to be set forth in the IGA, will be made at predefined intervals during construction, which is anticipated to commence in 2026. SD 103 and the Village will be responsible for design, construction, operation, and maintenance of the project. The IGA will contain provisions that allow the District to review the project’s design and perform inspections after construction. The IGA will also require SD 103 and the Village to advertise and award the construction contracts in conformance with the District’s Purchasing Act, Multi-Project Labor Agreement, and Affirmative Action Requirements.

The Affirmative Action goals to be applied will conform with the current requirements of the District’s Affirmative Action Ordinance upon execution of this IGA. After construction, the Affirmative Action utilization on this project will be provided in an annual report summarizing goal attainment on stormwater partnerships.

 

Based on the foregoing, it is requested that the Board of Commissioners grant authority for the District to negotiate and enter into an IGA with and make payment to the Board and the Village in an amount not to exceed $386,100.00. It is further requested that the Chairman of the Committee on Finance, Acting Executive Director, and Clerk be authorized to execute said agreement on behalf of the District, as well as any documents necessary to effectuate the transaction and conveyance, upon approval by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.

 

Funds in the amount of $386,100.00 are anticipated to be spent over a 10-month period, in accordance with the agreement after it is executed. Funds from Account 501-50000-612400 requested in future years are contingent on the Board of Commissioners’ approval of the District’s budget for those years.
