Dear Sir:

 

On January 24, 2019, the Board of Commissioners authorized the Director of Procurement and Materials Management to award Contract 11-186-3F, Addison Creek Reservoir, Bellwood, Illinois to IHC Construction Companies, in an amount not to exceed $63,280,000.00, plus a five (5) percent allowance for change orders in an amount of $3,164,000.00, for a total amount not to exceed $66,444,000.00.  The contract expires on March 21, 2021.

 

This contract has no prior change orders.

 

The Addison Creek Reservoir site, located in Bellwood, IL, was formerly occupied by an automotive parts manufacturer until 1989 when the IEPA documented the completion of the facility’s closure plan.  The facility later became a leased storage facility site until it was acquired by the District. During design of the reservoir, an environmental site assessment was performed, and it was determined that some areas of concern with environmental contamination were present on the site, which could require special handling and disposal. Provisions were incorporated into the District‘s construction contract for these unknown contaminations issues, and have been utilized for removal of non-special waste since construction began.

 

During ongoing excavation work in late November 2019, field screening identified additional, and previously unknown, contamination at the Addison Creek Reservoir site. In December 2019 and January 2020, the District conducted additional subsurface investigations to better locate, quantify, and categorize this contamination for remediation purpose. Testing has identified an estimated 6,500 cubic yards of chlorinated solvent-impacted soil which may be categorized as hazardous waste once excavated and profiled for off-site disposal. On February 21, 2020, the District requested a proposal (RFP-6) from our contractor for this remediation work.

 

On April 8, 2020, the Contractor submitted cost proposal in an amount not to exceed $6,390,702.29.  The Engineer reviewed the cost proposal and found it reasonable for the work described.  The payments for the work covered under this change order will be based upon actual costs incurred and proper documentation to be submitted by the contractor and approved by the District.

 

This change order is in compliance with the Illinois Criminal Code since the change is due to circumstances not reasonably foreseeable at the time the contract was signed and is in the best interest of the District. 

 

It is hereby recommended that the Board of Commissioners authorize the Director of Procurement and Materials Management to execute a change order to increase Contract 11-186-3F in an amount of $6,390,702.29 (10.10% of the current contract value), from an amount of $63,280,000.00, to an amount not to exceed $69,670,702.29.

 

Funds are available in Account 501-50000-645620.
