Authority to grant the City of Palos Hills a 16-year, approximately 30’ x 700’ non-exclusive easement to construct, operate, and maintain a bicycle path on District real estate located along the north side of the Cal-Sag Channel between Roberts Road and Southwest Highway in Palos Hills, Illinois; Cal-Sag Channel Parcel 8.03. Consideration shall be a nominal fee of $10.00

Dear Sir:

 

The City of Palos Hills (“Palos Hills”) leases approximately 172± acres of District real estate located along the north side of the Cal-Sag Channel between Kean Avenue and Southwest Highway in Palos Hills, Illinois, known as Cal-Sag Channel (“CSC”) Parcels 6.01, 7.01, and 8.09, for public recreational purposes, including a bicycle path. The lease commenced May 16, 2002, and expires May 15, 2041.

 

Palos Hills has submitted design plans to begin construction of a 7,500’ bicycle path on its leasehold. A portion of the bicycle path will cross over CSC Parcel 8.03, which is currently under lease to Consolidated High School District 230 (“CSD 230”). Palos Hills has therefore requested an approximately 30’ x 700’ non-exclusive easement over CSC Parcel 8.03 to construct, operate, and maintain that segment of the bicycle path. The requested term of the easement is 16 years to coincide with the remainder of the term of Palos Hills’ lease. CSD 230 has provided its consent to the easement request.

 

The District’s technical departments have reviewed Palos Hills’ request and have no objections thereto. A nominal fee of $10.00 is recommended as is customary for government agencies using District property for public recreational purposes.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize the District to grant a 16-year, approximately 30’ x 700’ non-exclusive easement to construct, operate, and maintain a bicycle path on District real estate located along the north side of the Cal-Sag Channel between Roberts Road and Southwest Highway in Palos Hills, Illinois; Cal-Sag Channel Parcel 8.03. Consideration shall be a nominal fee of $10.00.

 

It is further requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute said easement agreement after it is approved by the General Counsel as to form and legality.
