Dear Sir:
 
James Daly is a Structural Ironworker at the Stickney Water Reclamation Plant.  On December 15, 2008, he slipped on ice while performing his job duties, sustaining an injury to his right shoulder.
 
Mr. Daly was diagnosed with a partial tear to the supraspinatus tendon and labrum.  On March 7, 2009, he underwent surgical debridement of the distal clavicle and subacromial decompression.  His recovery was complicated, and he ultimately required a second surgery on December 9, 2009.  After a guarded course of physical therapy, he was released to work on July 13, 2010.  He lost 81 weeks from work.
 
Mr. Daly filed an Application for Adjustment of Claim with the IWCC through his attorney.  Subject to the approval of the IWCC, this claim can now be settled for the sum of $54,656.60, which represents 32.5% loss of use of the right arm (approximately 16.4% of the body as a whole), and would close out all future medical exposure on this claim.
 
The General Counsel believes this settlement is in the best interest of the District and requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.
