Consent to assignment of easement agreement dated May 5, 2016, from American Grading Co. to Duridge RE Holdings LLC to use and maintain an access road on 71,226 sq. ft. of District real estate located along the eastern edge of the District’s Mainstream Pumping Station in Hodgkins, Illinois, known as Main Channel Parcel 33.07. Consideration shall be a document preparation fee of $5,000.00

Dear Sir:
On May 5, 2016, the Board of Commissioners authorized the District to grant a 60-year non-exclusive easement to American Grading Co. (“AGC”) for the construction, reconstruction, operation, maintenance, repair, and removal of a 71,226 square foot access road located along the eastern edge of the District’s Mainstream Pumping Station in Hodgkins, Illinois to access its landlocked property. The easement commenced July 1, 2016, and expires June 30, 2076. AGC’s current annual easement fee is $3,952.86. The easement allows AGC to assign the easement subject to the District’s written consent.
AGC is selling its property adjacent to the Mainstream Pumping Station to Duridge RE Holdings LLC (“Duridge”) and has requested the District’s consent to assign its access easement to Duridge. An initial annual easement fee of $5,500.00 is recommended based upon recent appraisals of nearby comparable sites.
The District’s Finance Department has reviewed Duridge’s financial and company background information and determined that it demonstrates the ability to meet the annual fee obligation under the easement.
It is requested that the Executive Director recommend to the Board of Commissioners that it consent to the assignment of easement agreement dated May 5, 2016, from American Grading Co. to Duridge RE Holdings LLC to use and maintain an access road on 71,226 sq. ft. of District real estate located along the eastern edge of the District’s Mainstream Pumping Station in Hodgkins, Illinois, known as Main Channel Parcel 33.07. Consideration shall be a document preparation fee of $5,000.00.
It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute said Consent to Assignment of Easement Agreement after it is approved by the General Counsel as to form and legality.
