Dear Sir:
In 2008, the U. S. Army Corps of Engineers (“Corps”) commenced the Lockport Trench Rehabilitation Project in the Chicago Sanitary and Ship Canal in Cook, DuPage, and Will Counties, that includes constructing a trench along with a cutoff wall to prevent seepage through the approach dike and to improve the stability of the high hazard approach dike. The construction has resulted in tons of spoil materials which has to be hauled away and deposited in a suitable area.
Bencor Corporation of America (“Bencor”), a contractor for the Rock Island District of the Corps, has requested to use Main Channel Parcels13.02 and 19.01 as permanent disposal sites for the slurry spoil material. Thus far, the majority of the cut-off wall materials are stockpiled at the Lockport Powerhouse and additional materials will accumulate until the project is completed.
The Engineering Department has designated two areas as suitable deposit areas for spoil materials and has recommended that Bencor’s request to deposit the spoil materials on District land be granted subject to certain conditions. The conditions include setting a maximum of approximately 12,000 cubic yards of spoil to remain at the Powerhouse site; a maximum of 6,000 cubic yards of acceptable spoil that may be transported by truck to Parcel 19.01; and, all spoil must be surveyed and approved by the Engineering Department’s environmental contractor. Engineering reports that the removal and re-location of clean spoil will also provide material for other District projects.
The recommended permit fee will be a document preparation fee of $2,000.00, as it is reported that the District will benefit from the removal and relocation of the spoil materials. The permit will be subject to the District’s standard conditions, including its insurance requirements.
It is requested that the Executive Director recommend to the Board of Commissioners that it authorize and approve the issuance of a 12-month permit to Bencor Corporation of America to use approximately 143 Acres of District land for spoil depositories located at Main Channel Parcels 13.02 and 19.01 in Lockport, Will County, Illinois. Consideration shall be a fee of $2,000.00.
It is further requested that the Executive Director recommend to the Board of Commissioners that it authorize the Chairman of the Committee on Finance and the Clerk to execute said permit agreement after it is approved by the General Counsel as to form and legality.
