Title

Authorization to issue a seven (7) month permit to The Peoples Gas Light and Coke Company to perform environmental testing in the Main Channel adjacent to Parcels 40.02, 40.04 and 40.07 and upstream & downstream approximately one-quarter mile.  Consideration shall be a standard documentation fee of $5,000.00

Dear Sir:

 

The Peoples Gas Light and Coke Company (“Peoples Gas”) leases Main Channel Parcel 40.02 and a portion of 40.07 located west of Pulaski Road and north of the Main Channel in Chicago, Illinois under a 99-year lease that commenced in 1917 and expires October 31, 2016, for operation and maintenance of its natural gas pipeline.  Peoples Gas occupies Main Channel Parcel 40.04 and a portion of 40.07 under a permit that expires October 31, 2016.  Under the permit, (and under its lease) Peoples Gas is performing environmental testing to determine if District property was contaminated as a result of migration from Peoples Gas’ Manufactured Gas Plant (MGP) site located north of its leasehold and as a result of certain historical ancillary MGP operations on the subject site during the first half of the Peoples Gas lease term.

 

Peoples Gas has now requested to perform environmental testing in the Main Channel adjacent to Main Channel Parcels 40.02, 40.04 and 40.07 and upstream and downstream approximately one-quarter mile to determine if any of the MGP contaminants migrated into the Main Channel.

 

A seven (7) month permit is recommended so that the permit expires on October 31, 2016 to coincide with the expiration dates of the permit and lease agreements.

 

The technical departments have no objections to this issuance of the permit.  A standard documentation fee of $5,000.00 is recommended since Peoples Gas will only be performing environmental testing in the Main Channel.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize the issuance of a seven (7) month permit to The Peoples Gas Light and Coke Company to perform environmental testing in the Main Channel adjacent to Parcels 40.02, 40.04 and 40.07 and upstream and downstream approximately one-quarter mile.  Consideration will be a standard documentation fee of $5,000.00.

 

It is further requested that the Executive Director recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said permit after it has been approved by the General Counsel as to form and legality.
