Consent to Cricket Communications’ Collocation of Six (6) Antennas and Related Equipment on a Tower and Land Located within a 600 Square Foot Easement Granted to SprintCom Inc., Located on District Land at I-55 and the B & O Railroad in Summit, Illinois. The consideration shall be an initial annual fee of $10,200.00

Dear Sir:

 

On August 6, 1998, the Board of Commissioners authorized the grant of a 25-year easement to SprintCom Inc., to use a 600 square foot parcel of District real estate located at I-55 and the B & O Railroad in Summit, Illinois, for the construction of an antenna tower and appurtenances related thereto.  The annual easement fee is $18,720.00 per annum.  The easement will expire on October 18, 2023.

 

The subject easement agreement provided that the tower would be constructed to provide for collocation of other antennas on the tower.  The easement agreement further provides that any collocation would be subject to the District’s approval. The District will receive 50% of any collocation fees received by SprintCom from any third party.

 

Global Signal Acquisitions III LLC.,an agent of SprintCom, Inc., has advised the District that Cricket Communications has requested to locate six (6) antennas on the tower and to use a portion of the 600 square foot easement premises to locate its related equipment. Cricket Communications will pay Global Signal Acquisitions III LLC., an initial collocation fee of $20,400.00 annually.  The District’s 50% share of the initial collocation fee will be $10,200.00 annually.  The fee will increase 3% each year.  The term of the collocation will be for the remaining 16 years of the SprintCom easement   agreement.    The collocation will require  compliance with  the terms of the underlying  easement  agreement, including  a guarantee of non-inference with the District’s communication system.  Global Signal Acquisitions III LLC. has requested that the District consent to Cricket Communications’ collocation.  The District’s technical departments have reviewed the subject request and have no objections thereto.

 

It is requested that the General Superintendent recommend to the Board of Commissioners that it consent to Cricket Communications’ collocation of six (6) antennas and related equipment on a tower and land located within a 600 square foot easement granted to SprintCom Inc., located at I-55 and the B & O Railroad in Summit, Illinois.  The consideration shall be an initial annual fee of $10,200.00.

It is further requested that the General Superintendent recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said Consent document after same is approved by the Attorney as to form and legality.
