Dear Sir:
 
Gilbert Gonzalez is a Maintenance Laborer A Shift Foreman who works at the Calumet Water Reclamation Plant.  On January 11, 2010, he was inspecting a manhole and in the process slipped on a ladder rung falling approximately ten feet to the base of the structure.  As a result of this accident, Mr. Gonzalez sustained a fracture of his left ankle.
 
Mr. Gonzalez was taken to the emergency room and referred to an orthopedic specialist.  He underwent a left bimalleolar ankle fracture open reduction and internal fixation on January 27, 2010.  During his operation, it was determined that screws would not allow for a good fixation.  A tubular plate was contoured to his tibia, and multiple screws were then placed to reduce the fracture and hold it.  To secure the lateral joint of the fracture, the surgeon chose an Acumed fibular rod which was impacted into place without screws since the open fracture site was not easily accessible.
 
Mr. Gonzalez underwent a course of physical therapy following surgery and returned to work on August 16, 2010.  He was paid a total of 30-3/5th weeks of lost time benefits for this injury.
 
Mr. Gonzalez is represented by an attorney for this claim.  After a course of negotiations, the District was able to resolve this claim for 40% loss of use of the left foot.  Subject to the approval of the Illinois Workers' Compensation Commission, this case can be settled for a total of $44,403.30.
 
The General Counsel believes this settlement is in the best interest of the District and requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.
