Dear Sir:

 

Edward Kaminski is an MLAS at the Stickney Water Reclamation Plant.  On December 6, 2005, while trying to avoid sludge splashing from a sink, he jumped back and started to fall.  He grabbed onto a railing to stop his fall and felt a pop in his right shoulder.  He went to Clearing Clinic and was diagnosed with a possible rotator cuff tear.  An MR arthrogram on December 15, 2005 revealed a large full thickness tear in the rotator cuff.  Kaminski underwent surgery to repair the tear on January 11, 2006.  He completed a physical therapy program.  He lost 133 days of work.

 

On April 13, 2007, Kaminski tripped over a pipe as he was stepping backward and fell onto his right upper back.  He was diagnosed with an upper dorsal spine contusion.  He had physical therapy and lost 40 days of work.

 

On November 22, 2007, Kaminski injured his right shoulder when he pulled a hose that was stuck.  He was diagnosed with biceps tendonitis of his right shoulder.  Treatment included a cortisone injection and physical therapy.  He lost no time from work.

 

Subject to the approval of the Illinois Workers’ Compensation Commission, these three claims can be settled for the sum of $38,938.47, which represents a 28% loss of use of the right arm.  The Attorney requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.
