Dear Sir:

 

On March 7, 2024, the Board of Commissioners authorized the Director of Procurement and Materials Management to advertise for bids Contract 24-601-21, Mechanical Process Improvements at Various Locations.

 

In response to a public advertisement of August 21, 2024, a bid opening was held on October 15, 2024. The bid tabulation for this contract is:

 

GROUP A:  MECHANICAL PROCESS IMPROVEMENTS

INDEPENDENT MECHANICAL INDUSTRIES, INC.                     $8,991,250.00

JOHN BURNS CONSTRUCTION COMPANY LLC                     $754,700.00

No bids were received for Group C.

 

Independent Mechanical Industries, Inc. (Independent), the lowest responsible bidder for Group A is proposing to perform the contract in accordance with the specifications. The estimated cost for Group A is $7,380,000.00, placing the bid of $8,991,250.00, approximately 21.8 percent above the estimate.

 

John Burns Construction Company, LLC (Burns), the lowest responsible bidder for Groups B and D, is proposing to perform the contract in accordance with the specifications. The estimated cost for Groups B and D is $8,995,500.00, placing the bid of $8,867,700.00, approximately 1.4 percent below the estimate.

 

The Affirmative Action Ordinance Revised Appendix D goals for this contract are 20 percent Minority Business Enterprise (MBE) and 9 percent Women Business Enterprise (WBE). The goal for Veteran-Owned Business Enterprise (VBE) is 3 percent. The goals above apply to each group.

 

Independent is in compliance with the Affirmative Action Ordinance Revised Appendix D for Group A, as indicated on the attached report. The MBE and WBE utilization goals offered for this contract are 20.58 percent MBE and 10.01 percent WBE. The policy goal for VBE participation offered is 3.34 percent.

Burns is in compliance with the Affirmative Action Ordinance Revised Appendix D for Group B as indicated on the attached report. The MBE and WBE utilization goals offered for this contract are 20.92 percent MBE and 12.34 percent WBE. The policy goal for VBE participation offered is 3.45 percent.

 

Burns is in compliance with the Affirmative Action Ordinance Revised Appendix D for Group D as indicated on the attached report. The MBE and WBE utilization goals offered for this contract are 20.03 percent MBE and 9.01 percent WBE. The policy goal for VBE participation offered is 3.01 percent.

 

Independent has executed the Multi-Project Labor Agreement (MPLA) certificate as required. It is anticipated that the following trades will be utilized on this contract: painters, laborers, truck drivers, carpenters, bricklayers, ironworkers, plumbers, insulators, electricians, pipefitters, machinists, and millwrights. The list of construction trades is not intended to confer any rights or jurisdiction upon any union or unions.

 

Burns has executed the Multi-Project Labor Agreement (MPLA) certificate as required. In view of the foregoing, it is recommended that the Director of Procurement and Materials Management be authorized to award Contract 24-601-21, Group A, to Independent Mechanical Industries, Inc. in an amount not to exceed $8,991,250.00, subject to the contractor furnishing a performance bond in form satisfactory to the Law Department and approved by the Director of Procurement and Materials Management.

 

In view of the foregoing, it is recommended that the Director of Procurement and Materials Management be authorized to award Contract 24-601-21, Groups B and D, to John Burns Construction Company, LLC in an amount not to exceed $8,867,700.00, subject to the contractor furnishing a performance bond in form satisfactory to the Law Department and approved by the Director of Procurement and Materials Management.

 

The contractor shall commence work upon approval of the contractor’s bond and terminate thirty-six (36) months thereafter.

 

The contract will employ approximately 10-12 people for the services.

 

Funds for the 2024 expenditures for Group A, in the amount of $129,000.00, are available in Account 201-50000-645750. The estimated expenditures for 2025 are $5,146,250.00, and for 2026 are $3,716,000.00. Funds for the 2025 and 2026 expenditures are contingent on the Board of Commissioners’ approval of the District’s budget for those years.

 

Funds for the 2024 expenditures for Group B, in the amount of $16,900.00, are available in Account 201-50000-645750. The estimated expenditures for 2025 are $409,400.00, and for 2026 are $328,400.00. Funds for the 2025 and 2026 expenditures are contingent on the Board of Commissioners’ approval of the District’s budget for those years.

 

Funds for the 2024 expenditures for Group D, in the amount of $193,600.00, are available in Account 201-50000-645750. The estimated expenditures for 2025 are $4,740,100.00, and for 2026 are $3,179,300.00. Funds for the 2025 and 2026 expenditures are contingent on the Board of Commissioners’ approval of the District’s budget for those years.
